Dont drive and talk

Will a law that only allows drivers to talk on their cellphones using hands-free devices reduce road deaths in Trinidad and Tobago? Last month, Works and Transport Minister Jack Warner announced that the Government was bringing legislation to outlaw talking on cellphones while driving. Drivers who break the new law will face a $5,000 fine or two-months' hard labour in jail.
Although Warner referred to one Canadian study which showed that drivers using their mobile phones are 18 times more likely to cause an accident, no local research has been done on the link between mobile phones and traffic accidents.
Brent Batson, operations manager at safety company Training and Logistics Ltd and technical adviser to the NGO Arrive Alive, says, "The analysis of local data does not permit an accurate reflection on the true causes of road traffic collisions. Without this, it's shooting arrows randomly in the dark."
So, while it is possible to show a correlation between increased cellphone use in Trinidad and Tobago and an increase in vehicular accidents, this doesn't necessarily mean that cellphones are the cause of more accidents.
As Table 1 shows, in 2000, only one in every 10 persons had a cell-phone. By 2008, most Trinbagonians had one or more. Between 2003 and 2004, when cellphone penetration jumped from 28 per cent to 40 per cent, there was an 8 per cent increase in reported accidents, as well as a 10 per cent increase in fatal accidents. In 2006, when Digicel entered the mobile phone market to compete with bmobile, cellphone penetration went from 70 per cent to 115 per cent.
Correlation, however, is not causation. Between 2000 and 2007, the number of registered vehicles in T&T increased by 44 per cent. That alone might account for the higher number of road accidents. One interesting point is that registered vehicles increased by just six per cent between 2006 and 2007, and the number of reported accidents increased by just 2 per cent while the number of fatalities stayed the same. In 2008, with mobile phone penetration at 138 per cent, reported accidents increased by 1.3 per cent and fatal accidents by 24 per cent. Again, though, this is only correlation, not causation, and in 2009 traffic fatalities actually dropped by 23 per cent, and road fatalities by 21 per cent. The most significant correlation here was a whopping 31 per cent decline in car sales compared to 2008, according to Central Bank estimates, most likely because of the global recession.
A 2005 report written by researcher Dean Sugano for the Hawaii state legislature, which was considering similar laws at the time, gave an overview of research into mobile phones and vehicle accidents. The report said: "The studies generally do not prove or disprove that cellular telephone use while operating a motor vehicle is a cause of motor vehicle collisions. Instead, the studies generally find that a statistical association, not necessarily a causal relation, exists between cellular telephone use while operating a motor vehicle and motor vehicle collisions."
The only way to prove causality would be to survey two groups of drivers, one using cellphones and the other not, and see which group was involved in more accidents: but such an experiment would be unethical. Studies from the United States and other countries suggest that the Government's proposed law will make little or no difference to the number of road fatalities. Drivers will be allowed to talk on cellphones while driving, provided they use a hands-free device. However, a 2005 paper written by Suzanne P McEvoy and others, published in the British Medical Journal, while noting that cellphone use made an accident four times more likely, said that "According to our study, there is no safety advantage associated with switching to the types of hands-free devices that are commonly in use."
Sugano also notes that "Contrary to expectations, the majority of drivers were talking on their telephones rather than dialling at the time of the crash. The results bolstered the researchers' theory that cellphone users look but don't really 'see' or pay attention to their surroundings." In other words, the problem is having a conversation, not holding the phone. A 2010 report from the Highway Loss Data Institute, a research organisation funded by the insurance industry in the US, analysed the claims rates in four jurisdictions with laws barring motorists from using cell phones without hands-free devices, and found no change in accident rates once the bans took effect.
Batson, who has been in the safety business for the past 14 years, notes that other measures recently instituted in T&T seem to be having a good effect. In April, for example, fines for traffic violations were raised significantly. Thus, failing to wear a seatbelt, or having no park-light or indicator light, carries a $1,000 fine. "An audit by Arrive Alive showed a 90 per cent increase in seat-belt use," says Batson. He also said that more drivers were taking their vehicles to inspection depots and fixing defects. "The main key to creating a safety culture is enforcement," he says. Batson claims that there's also improvement at the root: licensing officers are now failing more persons on their driving tests. These officers have been given more training in assessing applicants, Batson says. "Their eyes are open now to the risks of passing a bad driver." He adds that this new approach will also impose standards on driving instructors who, at present, need no formal qualifications to open a driving school. "A change in driver behaviour is only going to be addressed through driver education," Batson asserts.
Other measures have to be put in place, too. The Government needs to curb excessive speeding, but this requires appropriate technology. "Right now for the police or Licensing Officers to enforce speed violations would itself be a safety violation," says Batson, since officers have to step out on the roadway and stop a speeding car. The main causes of vehicle accidents are shown in Box 1.
Talking on cellphones falls under distractions, which also include watching other people or the scenery, fiddling with the CD player, eating, putting on make-up, and even reading while driving. Batson admits that the issue of cell-phone use is a complex one, and only time will tell if the new legislation would reduce traffic fatalities. "It is the society evolving with technology," he says.
